These two gentlemen were in enoh position that they knew, and knowing, testified clearly and noderstandingly . by the transaction, I am of the opinion that tho Wilming ton and Weldon railroad oompany have failed to bring that preponderance ; of proof which ia neoesssry to warrant me in sustaining them in their viewa on this point.; i-1 ft ...!. i,Vf in conclusion, 1 would say, that i nave eonaidered all the points raised by the de feudants, the Wilmington and Weldon railroad eompany,inoluding the one raised by the supplemental and amended answer.
